Returns and Refunds Policy

This policy governs the returns, cancellations, replacements, and refunds applicable to the operations offered through the site, including reservations, purchases, and other cases as applicable depending on the relevant modality.

This policy should be read together with the Terms and Conditions, the Privacy Policy and, where applicable, the specific conditions of each offer, campaign, promotion, contest, sweepstakes, product, or applicable modality. In the event of any conflict regarding a specific transaction, the conditions specifically applicable to that transaction shall prevail.

1. Scope of this policy

This Returns and Refunds Policy governs the conditions applicable to:

  • reservations offered through the site;
  • purchases of physical products and accessories offered through the site;
  • defective products, initial failures, or issues covered by applicable warranty;
  • damage attributable to transportation;
  • shipping errors or delivery of incorrect products;
  • cancellations, replacements, returns, and refunds.

This policy shall apply without prejudice to any non-waivable rights that may correspond to the user under the mandatory legislation applicable in each case.

2. Reservations

2.1 Nature of the reservation

A reservation does not by itself constitute a final purchase of the product. Unless expressly stated otherwise, a reservation grants only the right, priority, commercial benefit, or credit expressly stated in the applicable offer.

2.2 General refundability rule

As a general rule, a reservation is non-refundable. The amount paid for the reservation may be 100% creditable toward the final price of the main reserved product where so stated for the corresponding program, but this does not by itself imply that the reservation may be freely canceled with a refund of the amount paid.

2.3 Cases in which CubeVox may allow a refund of a reservation

CubeVox may allow a refund of a reservation when any of the following occurs:

  • definitive cancellation of the product or reservation program by CubeVox;
  • a material adverse change with respect to the characteristics or main uses expressly announced at the time of reservation;
  • an extraordinary delay beyond the threshold or deadline that CubeVox publishes or notifies for the applicable program;
  • any case in which a refund is required by the mandatory applicable legislation.

2.4 Cases in which the reservation will not give rise to a refund

Unless otherwise required by mandatory law or expressly published as a specific condition, a reservation will not give rise to a refund for reasons such as:

  • the user changing their mind;
  • loss of interest in the product;
  • delays that do not exceed the extraordinary threshold applicable to the program;
  • non-material changes in design, materials, components, software, firmware, packaging, interfaces, or equivalent or superior features.

2.5 Invitation to complete the purchase

Where a reservation contemplates a future invitation to complete the purchase, CubeVox may establish a specific time window to exercise the priority, confirm information, select an available version, or complete the remaining payment. If the user does not act within the stated period, CubeVox may consider the priority, promotional benefit, or preferential condition associated with the reservation extinguished, with the scope set forth in the specific terms of the program, without this giving rise to an automatic right to a refund unless expressly stated or required by the mandatory applicable legislation.

3. Purchases of physical products and accessories

3.1 Future application

This section shall apply when CubeVox enables the regular purchase of physical products and accessories through the site.

3.2 Return requests based on withdrawal or commercial convenience

Any return of non-defective products shall be subject to the mandatory applicable legislation and, where applicable, to the specific commercial conditions that CubeVox publishes for the product, campaign, territory, or corresponding purchase flow.

3.3 Accessories

Unless otherwise stated in the applicable offer or unless mandatory legislation establishes a different regime, accessories shall be governed by the same general rules applicable to physical products, without prejudice to any particular exclusions that may apply due to their nature, use, sealing, activation, customization, or special marketing conditions.

4. Defective products or faulty items

4.1 Initial failures or defective product upon receipt

If a product arrives with an obvious defect, does not turn on, does not function in a basic manner, or presents an initial defect attributable to manufacturing or quality control, the user must report it within a reasonable period after receipt, providing the order number, a description of the problem, and reasonable evidence such as photos or video where necessary to assess the case.

4.2 Possible remedies

Once the defect or fault is verified, CubeVox may offer, depending on the nature of the case and the applicable law:

  • replacement of the product;
  • repair;
  • exchange for another equivalent product;
  • store credit;
  • refund.

4.3 Cases not covered as defects

The following, among others, shall not be considered covered defects: damage or failures caused by impacts, drops, humidity, liquids, incorrect installation, improper use, unauthorized modifications, normal wear and tear, intervention by unauthorized third parties, or failure to follow usage instructions.

5. Shipping damage

If the order arrives with visible damage attributable to transport, the user must note it with the carrier where possible, take photographs of the packaging and the product, and report it to CubeVox within a reasonable time after receipt.

Once damage attributable to transport is verified, CubeVox may offer replacement, exchange, retrieval of the damaged product, or refund, as appropriate.

6. Shipping errors

If the user receives an incorrect product, the wrong variant, missing units, or an unsolicited item, they must report it within a reasonable time after receipt.

Once the error is verified, CubeVox may send the correct product, arrange the return or retrieval of the incorrect product, complete missing items, or issue the corresponding refund.

7. General conditions for accepting returns

Where a return of a non-defective physical product applies or where CubeVox accepts it commercially, the product must retain, to the extent reasonable depending on the case:

  • its general physical integrity;
  • its accessories, manuals, and included items;
  • its original packaging or suitable packaging for return;
  • a condition compatible with simple inspection and not with improper or intensive use, unless applicable law provides otherwise.

CubeVox may reject returns when the product is incomplete, damaged due to causes attributable to the user, altered, intervened without authorization, or in conditions incompatible with the requested return, without prejudice to any rights that are legally non-waivable.

8. Return shipping costs

Unless otherwise required by mandatory law or by a specific commercial condition published by CubeVox:

  • return shipping costs shall be borne by CubeVox where the reason is a verified defect, damage attributable to transport, shipping error, or breach attributable to CubeVox;
  • return shipping costs may be borne by the user where the return is due to withdrawal, personal convenience, incompatibility not attributable to CubeVox, or other cases not attributable to CubeVox.

9. Refund method and timing

Where a refund applies, CubeVox will seek to issue it through the same payment method originally used or through an equivalent mechanism where that is not technically possible.

Posting times may depend on the issuer, financial institution, payment network, or provider involved. CubeVox shall not be responsible for delays attributable exclusively to such third parties, without prejudice to any legal obligations that may apply to CubeVox.

10. Exclusions and cases where it does not apply

Unless otherwise required by mandatory law, returns or refunds shall not apply in cases such as:

  • reservations outside the expressly admitted cases;
  • products damaged by misuse, impacts, liquids, unauthorized intervention, or incorrect installation;
  • incomplete products due to causes attributable to the user;
  • claims submitted outside reasonable timeframes where this prevents verification of the case;
  • cases excluded due to the nature of the product or due to special conditions expressly communicated to the user before contracting.

12. Updates to this policy

CubeVox may update this Returns and Refunds Policy to reflect operational, commercial, logistical, regulatory, or product-, campaign-, or provider-related changes. The version in force shall be the one published on the site at any given time, indicating its latest update date.

Each reservation, purchase, or operation shall be governed by the policy in force on the confirmation date of that operation, unless a mandatory rule provides otherwise or a later update is more favorable to the user.
